• संयुक्त राष्ट्र की परिभाषा के अनुसार, यह अधिकार जाति, लिंग, राष्ट्रीयता, भाषा, धर्म या किसी अन्य आधार पर भेदभाव किए बिना सभी को प्राप्त हैं।
• मानवाधिकारों में मुख्यतः जीवन और स्वतंत्रता का अधिकार, गुलामी और यातना से मुक्ति का अधिकार, अभिव्यक्ति की स्वतंत्रता का अधिकार और काम एवं शिक्षा का अधिकार, आदि शामिल हैं।
• कोई भी व्यक्ति बिना किसी भेदभाव के इन अधिकारों को प्राप्त करने का हक़दार होता है।
• मानव अधिकार संरक्षण अधिनियम, 1993 के प्रावधानों के तहत 12 अक्टूबर, 1993 को राष्ट्रीय मानव अधिकार आयोग (National Human Rights Commission-NHRC) की स्थापना की गई।

क्यों ज़रूरी हैं व्यक्ति के जीवन में मानव अधिकार, जानिए Human Rights in Hindi की लिस्ट में, जो इस प्रकार हैं:

• शारीरिक स्वतंत्रता के लिए
• गिरफ्तारी व अन्य बेवजह रोककर रखने के प्रविर्ती में मुक्ति के लिए
• मनुष्य के आत्म सम्मान को बचाकर रखने के लिए 
• मनुष्य के मौलिक अधिकारों को बचके रखने के लिए 
• जीवन स्तर को उच्च बनाने के लिए

• राष्ट्रीय एवं अंतराष्ट्रीय गौरव एवं शांति बनाने के लिए 
• मानव के सर्वागीण विकाश के लिए
• न्याय के रक्षा के लिए

नौकरशाही पर रोक लगाना, मानव अधिकारों के हनन को रोकना तथा लोक सेवक द्वारा उनका शोषण करने में अंकुश लगाना। मानवाधिकार की सुरक्षा के बिना सामाजिक, आर्थिक और राजनीतिक आज़ादी खोखली है, मानवाधिकार की लड़ाई हम सभी की लड़ाई है। विश्वभर में नस्ल, धर्म, जाति के नाम मानव द्वारा मानव का शोषण हो रहा है। अत्याचार को रोकना एक बेहद ज़रूरी कार्य है। हमारे देश में स्वतंत्रता के बाद धर्म और जाति के नाम पर भारतवासियों को विभाजित करने का प्रयास किया जा रहा है। आदमी का रंग कैसा भी हो, हिन्दू हो या मुस्लमान, सिख हो या ईसाई, हिंदी बोले या कोई अन्य भाषा, सभी केवल इंसान हैं और संयुक्त राष्ट्र संघ द्वारा घोषित मानवाधिकारों को प्राप्त करने का अधिकार हैं।

मानव अधिकार के प्रकार नीचे दिए गए हैं-

• गुलामी से मुक्ति
• कठोर, असभ्य माहौल अथवा सजा से मुक्ति
• लॉ के सामने बराबरी
• प्रभावशाली न्यायिक उपचार का अधिकार
• आवागमन तथा निवास स्थान चुनने की स्वतंत्रता
• शादी के बाद घर बसाने
• विचार अभिव्यक्ति की स्वतंत्रता
• निष्पक्ष मुकदमें का अधिकार

Human Rights in Hindi में आपको निम्नलिखित चीज़ों की लिस्ट दी जा रही है जिसके लिए Human Rights दुनिया भर में आवाज़ उठाने के लिए जाने जाते हैं।

• सभी गरीब बच्चों, महिला, बुजुर्ग व विक्लांग व्यक्तियों के लिऐ समान शिक्षा, मुफ्त  स्वास्थ्य जांच कैम्प लगाना और दवाईयां तथा उपकरण उपलब्ध कराना।
• सामाजिक बुराई के खिलाफ पहल करना और बुलंद आवाज उठाना तथा पीड़ितों को बुराई से छुटकारा दिलाना।
• बाल व बंधुआ मजदूरी के अत्याचार से मुक्ति दिलाना।
• बच्चों, महिलाओं तथा बुजुर्गो की रक्षा के लिए काम करना।
• समाज के लिए योगदान करने वाली हस्तियों को समय-समय पर पुरूस्कृत करके  उनका सम्मान करना।
• समाज व हर वर्ग के लोगो के साथ मिलकर विभिन्न कार्यक्रमों का आयोजन करना।
• जनता तथा पुलिस के बीच में सहयोग का पुल बनाना तथा पीड़ितों को न्याय दिलाना।
• नए शिक्षा संस्थान, अस्पताल व अनाथ आश्रम खोलना और अन्य आश्रमों की देख-रेख करना।
• भ्रूण हत्या पर हर सम्भव रोक लगाना व उनके खिलाफ आवाज उठाना।
• हर वर्ग के कमज़ोर व्यक्ति को समाज में न्याय दिलाना।

भारत ने मानवाधिकार संरक्षण अधिनियम, 1993 के तहत राष्ट्रीय मानवाधिकार आयोग का गठन और राज्य मानवाधिकार आयोगों के गठन की व्यवस्था करके मानवाधिकारों के उल्लंघनों से निपटने हेतु एक मंच प्रदान किया है। Human Rights in Hindi

• भारत में मानवाधिकारों की रक्षा के संदर्भ में राष्ट्रीय मानवाधिकार आयोग देश की सर्वोच्च संस्था के साथ-साथ मानवाधिकारों का लोकपाल भी है। सुप्रीम कोर्ट के पूर्व मुख्य न्यायाधीश इसके अध्यक्ष होते हैं। यह राष्ट्रीय मानवाधिकारों के वैश्विक गठबंधन का हिस्सा है। साथ ही यह राष्ट्रीय मानवाधिकार संस्थानों के एशिया पेसिफ़िक फोरम का संस्थापक सदस्य भी है। NHRC को मानवाधिकारों के संरक्षण और संवर्द्धन का अधिकार प्राप्त है।
• मानवाधिकार संरक्षण अधिनियम,1993 की धारा 12(ज) में NHRC समाज के विभिन्न वर्गों के बीच मानवाधिकार साक्षरता का प्रसार करेगा और प्रकाशनों, मीडिया, सेमिनारों तथा अन्य उपलब्ध साधनों के ज़रिये इन अधिकारों का संरक्षण करने के लिये उपलब्ध सुरक्षोपायों के बारे में जागरूकता बढ़ाएगा।
• इस आयोग ने देश में आम नागरिकों, बच्चों, महिलाओं, वृद्धजनों के मानवाधिकारों, LGBT समुदाय के लोगों के अधिकारों की रक्षा के लिये समय-समय पर अपनी सिफ़ारिशें सरकार तक पहुँचाई हैं और सरकार ने कई सिफारिशों पर अमल करते हुए संविधान में उपयुक्त संशोधन भी किए हैं।
• NHRC एक बहु-सदस्यीय संस्था है जिसमें एक अध्यक्ष सहित 7 सदस्य होते हैं।
• यह ज़रूरी है कि 7 सदस्यों में कम-से-कम 3 पदेन (Ex-officio) सदस्य हों।
• अध्यक्ष और सदस्यों की नियुक्ति राष्ट्रपति द्वारा प्रधानमंत्री की अध्यक्षता वाली उच्चस्तरीय कमेटी की सिफारिशों के आधार पर की जाती है।
• अध्यक्ष और सदस्यों का कार्यकाल 5 वर्षों या 70 वर्ष की उम्र, जो भी पहले हो, तक होता है।
• इन्हें केवल तभी हटाया जा सकता है जब सुप्रीम कोर्ट के न्यायाधीश की जाँच में उन पर दुराचार या असमर्थता के आरोप सिद्ध हो जाएं।

राष्ट्रीय मानवाधिकार आयोग के पास कुछ ऐसी शक्तियां हैं जिन्हें कोई भी रोकने की हिम्मत नहीं कर सकता। यह कार्य और शक्तियां आम लोगों के लिए ही हैं। आइए, बताते हैं –  

• मानवाधिकारों के उल्लंघन से संबंधित कोई मामला यदि NHRC के संज्ञान में आता है, तो NHRC को उसकी जाँच करने का अधिकार है।
• इसके पास मानवाधिकारों के उल्लंघन से संबंधित सभी न्यायिक मामलों में हस्तक्षेप करने का अधिकार है।
• आयोग किसी भी जेल का दौरा कर सकता है और जेल में बंद कैदियों की स्थिति का निरीक्षण एवं उसमे सुधार के लिये सुझाव दे सकता है।
• NHRC संविधान या किसी अन्य कानून द्वारा मानवाधिकारों को बचाने के लिये प्रदान किये गए सुरक्षा उपायों की समीक्षा कर सकता है और उनमें बदलावों की सिफारिश भी कर सकता है।
• NHRC मानवाधिकार के क्षेत्र में अनुसंधान का कार्य भी करता है।

राष्ट्रीय मानवाधिकार आयोग (Human Rights in Hindi) की अपनी भी कुछ सीमाएं हैं, जिनके आगे वह ज्यादा कुछ नहीं कर सकते । बताते हैं उनकी सीमाओं के बारे में –

• NHRC के पास जाँच करने के लिये कोई भी विशेष तंत्र नहीं है। अधिकतर मामलों में यह संबंधित सरकार को मामले की जाँच करने का आदेश देता है।
• पीड़ित पक्ष को व्यावहारिक न्याय देने में असमर्थ होने के कारण भारत के पूर्व अटॉर्नी जनरल सोली सोराबजी ने इसे ‘India’s teasing illusion’ की संज्ञा दी है।
• NHRC के पास किसी भी मामले के संबंध में मात्र सिफारिश करने का ही अधिकार है, वह किसी को निर्णय लागू करने के लिये बाध्य नहीं कर सकता।
• कई बार धन की अपर्याप्ता भी NHRC के कार्य में बाधा डालती है।

मानवाधिकार उच्चायुक्त कार्यालय, जिसे मानवाधिकारों के लिए संयुक्त राष्ट्र के उच्चायुक्त के कार्यालय के रूप में भी जाना जाता है। यह संयुक्त राष्ट्र मानवाधिकार निकायों में से एक है और संयुक्त राष्ट्र के सचिवालय का एक विभाग है, जो दुनियाभर में मानवाधिकारों की रक्षा करने के प्रतिबद्ध है। यह निकाय अन्तरराष्ट्रीय विधि के अन्तर्गत न्याय की ग्यारंटी देता है और 1948 के मानवाधिकारों की सार्वभौमिक घोषणा में निर्धारित हैं।

मानवाधिकार के लिए उच्चायुक्त का कार्यालय – ओएचसीएचआर

मानवाधिकार उच्चायुक्त का कार्यालय (OHCHR) को संयुक्त राष्ट्र महासभा (United Nations General Assembly) द्वारा दुनिया भर के लोगों के लिए सभी मानवाधिकारों की रक्षा को बढ़ावा देने के लिए अधिकृत किया गया है। नीचे इसके कुछ प्रमुख कार्यों के बारे में उल्लेख किया जा रहा है।

मानवाधिकार उच्चायुक्त का कार्यालय, संयुक्त राष्ट्र के 3 आपस में जुड़े स्तंभों (मानवाधिकार, शांति और सुरक्षा, विकास) की अखंडता को बनाए रखने में महत्वपूर्ण भूमिका निभाता है।

यह क्षेत्र में वैश्विक मानवाधिकार मानकों के कार्यान्वयन में सहायता के लिए तकनीकी विशेषज्ञता और क्षमता के विकास में सहायता प्रदान करता है।

यह मानवाधिकारों को सभी के लिए वास्तविकता बनाने में सरकारों की सक्रिय रूप से मदद करता है।

यह कार्यालय, समय-समय पर दुनिया भर में मानवाधिकारों के उल्लंघन से जुड़े मुद्दों पर अपनी राय व्यक्त करता है।

मानवाधिकार उच्चायुक्त का कार्यालय, संयुक्त राष्ट्र सचिवालय का एक हिस्सा है और इसे 1993 में स्थापित किया गया था।

इसका मुख्यालय जिनेवा में है और इसके कई क्षेत्रीय कार्यालय भी हैं।

ओएचसीएचआर का नेतृत्व मानवाधिकार के उच्चायुक्त करते हैं।

ओएचसीएचआर के कार्य

संयुक्त राष्ट्र मानवाधिकार उच्चायुक्त कार्यालय, दुनियाभर में मानव अधिकारों की रक्षा के लिए काम करता है, इसके मुख्य कार्य नीचे दिए जा रहे हैं –

मानवाधिकारों के उल्लंघन को रोकना।

मानव अधिकारों के लिए सम्मान को बढ़ावा देना।

मानवाधिकारों की रक्षा के लिए अंतर्राष्ट्रीय सहयोग को प्रोत्साहित करना।

संयुक्त राष्ट्र के भीतर मानवाधिकारों से संबंधित गतिविधियों का समन्वय, सुदृढ़ीकरण और सुव्यवस्थित करना।

भारत के संदर्भ में ओएचसीआर की भूमिका

मार्च 2020 में, OHCHR ने नागरिकता (संशोधन) अधिनियम (Citizenship (Amendment) Act) को चुनौती देने वाली याचिकाओं में शामिल होने के लिए भारत के सर्वोच्च न्यायालय में एक आवेदन दायर करने की मंशा जाहिर की थी।

जबकि ओएचसीएचआर ने सीएए के इरादों को प्रशंसनीय बताया था, जो कि उत्पीड़ित अल्पसंख्यकों की रक्षा के लिए है, इसमें कहा गया था कि कानून मानवाधिकारों के सवाल भी उठाता है (विशेष रूप से, कानून के समक्ष समानता और गैर-भेदभाव के संबंध में)।

ओएचसीआर कार्यालय ने भारत के पड़ोसी देशों पाकिस्तान, बांग्लादेश और अफगानिस्तान के बौद्धों, हिंदुओं, पारसियों, ईसाइयों, सिखों और जैनियों को नागरिकता देने की कसौटी पर सवाल उठाए थे।

कार्यालय ने कुछ प्रवासियों पर सीएए के प्रभाव के बारे में भी बात की थी।

नागरिकता (संशोधन) अधिनियम पर ओएचसीएचआर के रुख पर भारतीय विदेश मंत्रालय ने यह कहते हुए प्रतिक्रिया दी थी कि सीएए भारत के लिए एक आंतरिक मामला है और संसद के पास कानून बनाने का संप्रभु अधिकार है।

मंत्रालय ने यह भी कहा था कि इस मुद्दे पर किसी विदेशी निकाय को दखल देने का कोई अधिकार नहीं है।

मानवाधिकार उच्चायुक्त कार्यालय (संयुक्त राष्ट्र मानवाधिकार), मानव अधिकारों पर संयुक्त राष्ट्र की एक अग्रणी इकाई है। इसकी स्थापना संयुक्त राष्ट्र महासभा के प्रस्ताव 48/141 के अनुसार की गई थी। यह मानवाधिकारों की रक्षा करने, उन्हें बढ़ावा देने और इस संबंध में आवश्यक कार्यों को अंजाम देता है। यह निकाय दुनिया भर में अंतरराष्ट्रीय मानवाधिकार कानून के पालन को भी बढ़ावा देता है और इस उद्देश्य को ध्यान में रखते हुए, अंतरराष्ट्रीय कानूनी दायित्वों के कार्यान्वयन को सुनिश्चित करने के लिए, अपने संवैधानिक या न्यायिक कार्यों के साथ घरेलू अदालतों का समर्थन करता है।

1 सितंबर, 2018 को मिशेल बाचेलेट ने मानवाधिकारों संयुक्त राष्ट्र उच्चायुक्त के रूप में अपना कार्यभार ग्रहण किया था। मानवाधिकार के लिए उच्चायुक्त का कार्यालय 1993 में स्थापित किया गया था इसके बाद से सुश्री बचेलेट सातवीं आयुक्त हैं।

संयुक्त राष्ट्र ओएचसीएचआर की संरचना क्या है?

कार्यालय का नेतृत्व मानवाधिकार के उच्चायुक्त द्वारा किया जाता है, जो पूरे संयुक्त राष्ट्र प्रणाली में मानवाधिकार गतिविधियों का समन्वय करते हैं और स्विट्जरलैंड के जिनेवा में मानवाधिकार परिषद के सचिवालय के रूप में कार्य करते हैं।
